1. About these terms
These terms apply to use of this website and, unless different written terms are agreed, to business-to-business quotations and orders supplied by Park My Car Ltd (“we”, “us” or “our”). Our contact address is 175 Lillechurch Road, Dagenham, England, RM8 2EW. These terms are not intended for consumer purchases.
2. Website information
Website content is general information, not a product listing or binding offer. Images and category descriptions are illustrative. Availability, specifications, packaging, minimum quantities and other details may change. You must confirm that goods are suitable for your intended use and market before ordering.
3. Trade accounts and enquiries
Submitting an enquiry or account application does not oblige either party to trade and does not guarantee credit, exclusivity, stock or pricing. We may request reasonable business, identity, credit or delivery information and may accept, decline, suspend or close an account where lawful to do so.
4. Quotes and orders
A quote is valid only for the period stated and may be withdrawn before acceptance. Your order is an offer to buy. A contract arises when we issue written acceptance or dispatch the goods, whichever occurs first. Any variation or cancellation requires our written agreement. We may correct obvious clerical or pricing errors before accepting an order.
5. Prices, VAT and payment
Prices are stated in pounds sterling and exclude VAT, delivery, duties and other charges unless the quote says otherwise. Payment is due using the method and date stated on our invoice or order confirmation. We may require cleared funds before dispatch, suspend performance for overdue sums and charge any interest or recovery costs permitted by law.
6. Products and substitutions
Descriptions, colours, measurements and photographs are approximate unless expressly guaranteed. Packaging may vary. We will not make a material substitution without agreement. The buyer is responsible for checking compatibility, fitment, instructions, legal restrictions and suitability for its customers or vehicles.
7. Delivery
Delivery dates are estimates unless expressly agreed in writing as fixed. We are not liable for delay caused by incomplete instructions, lack of access, carrier disruption or events outside our reasonable control. The buyer must provide a safe, accurate delivery location and any access requirements. We may deliver in instalments where reasonable.
8. Risk, title and inspection
Risk passes on delivery to the agreed location or collection by the buyer or its carrier. Title remains with us until all sums due for the relevant goods have been paid in full. The buyer must inspect goods promptly and notify us in writing of visible shortage, damage or incorrect supply as soon as reasonably possible, retaining packaging and evidence.
9. Returns and faulty goods
Business returns require prior authorisation and must follow the instructions we provide. We may decline non-fault returns, or apply reasonable handling and collection charges, unless otherwise agreed. For goods shown to be defective at delivery, our responsibility is, at our option and subject to law, to repair, replace or refund the affected goods. This does not cover misuse, incorrect storage, installation, alteration, wear, accident or failure to follow instructions.
10. Liability
Nothing excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, we are not liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill or anticipated saving. Our total liability relating to an order will not exceed the amount paid or payable for the goods giving rise to the claim, except where law requires otherwise.
11. Events outside our control
We are not responsible for failure or delay caused by circumstances beyond our reasonable control, including transport disruption, supplier failure, utility or communications outage, industrial action, extreme weather, fire, flood, epidemic, government action or import restrictions. We will take reasonable steps to limit the effect and resume performance.
12. Intellectual property and acceptable use
Website text, design and original materials belong to us or our licensors. You may view and print reasonable extracts for internal business evaluation but may not republish, scrape, modify or commercially exploit them without permission. You must not interfere with the website, introduce malicious code or use it unlawfully.
13. Privacy
Our handling of personal information is described in our
Privacy Policy.
14. General
If a provision is unenforceable, the remaining provisions continue. Delay in enforcing a right is not a waiver. No third party may enforce these terms. The buyer may not transfer an order without our written agreement. Notices concerning an order should be sent to the contact details shown on the relevant quote or invoice.
15. Governing law
These terms and related disputes are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, unless we agree another dispute process in writing.
